¤ Livingston, juriste et par la suite sénateur de la Louisiane, est chargé par le pouvoir législatif de Louisiane de rédiger un nouveau code pénal. Son système de législation criminelle pour l'Etat de la Louisiane est fondé sur le code pénal de Jeremy Bentham. Sa proposition majeure est l'abolition de la peine capitale. Ce code connu sous le nom de "Code Livingston" est rédigé à la fois en anglais et en français mais il ne sera jamais adopté. Le code publié partiellement durant les années 1820, sera pratiquement achevé en 1824 mais il sera détruit lors d'un incendie et ne sera publié dans son entier qu'en 1833.

The "Enquiries" of Rush and Bradford and the Pennsylvania movement toward abolition of the death penalty had little immediate impact on the practices of other States. But in the early 1800's, Governors George and DeWitt Clinton and Daniel Tompkins unsuccessfully urged the New York Legislature to modify or end capital punishment. During this same period, Edward Livingston, an American lawyer who later became Secretary of State and Minister to France under President Andrew Jackson, was appointed by the Louisiana Legislature to draft a new penal code. At the center of his proposal was "the total abolition of capital punishment." His Introductory Report to the System of Penal Law Prepared for the State of Louisiana contained a systematic rebuttal of all arguments favoring capital punishment. Drafted in 1824, it was not published until 1833. This work was a tremendous impetus to the abolition movement for the next half century. In 1821, by appointment of the legislature, of which he had become a member in the preceding year, Livingston began the preparation of a new code of criminal law and procedure, afterwards known in Europe and America as the "Livingston Code". It was prepared in both French and English, as was required by the necessities of practice in Louisiana, and actually consisted of four sections: crimes and punishments, procedure, evidence in criminal cases, reform and prison discipline. Though substantially completed in 1824, when it was accidentally burned, and again in 1826, it was not printed in its entirety until 1833. It was never adopted by the state. It was at once reprinted in England, France and Germany, attracting wide praise by its remarkable simplicity and vigor, and especially by reason of its philanthropic provisions in the code of reform and prison discipline, which noticeably influenced the penal legislation of various countries. "American criminal codes were first compiled by Edward Livingston and later David Dudley Field. Livingston’s elaborate drafts for a federal criminal code and a Louisiana criminal code, completed in 1826, were both the most ambitious and the least successful efforts at criminal law codification in the United States. Livingston’s Penal Code was Benthamite both in scope and in substance. The Penal Code was divided into four separate codes comprising all aspects of penal law, from the definition of penal norms in a Code of Crimes and Punishments, to the imposition of those norms in a Code of Procedure and a Code of Evidence, and eventually to the actual infliction of sanctions in a Code of Reform and Prison Discipline. Each aspect of the penal law, and each corresponding code, were individually, and as a system, designed to rationalize penal law on the utilitarian principle that Bentham had derived from Cesare Beccaria’s famous treatise on Crimes and Punishments: la massima felicita divisa nel maggior numero". ¤ Scarce, the last edition of Dodoens' Cruydt-Boeck, one of the most influential and important botanical works of the 16th and 17th centuries. In 1659 Zacharias Wagenaer presented to the Bakufu an edition of this work after which it was translated and re-translated for some two centuries. The book was revised and enlarged by an unknown editor after a copy annotated by Joost van Ravelingen, who died in 1608, and contains a number of newly cut illustrations. The preface and the identifications of the plants (exept for those in the last part) are printed in a handsome 'civilité type. Une œuvre pédagogique emblématique qui influencera Maria Montessori et dont François Truffaut tirera son film "L'enfant sauvage".
On peut donc lire les Mémoires d'Itard, et plus encore sans doute le film qu'en a tiré François Truffaut, comme un hommage lucide au pédagogue, à ses grandeurs et ses contradictions, entre le " domestiquer " et " l'affranchir ". Une réflexion sur la responsabilité éducative suffisamment profonde et honnête pour ne pas asséner de leçons. Sans emphase philosophique ni triomphe méthodologique.

Jean Itard est né en Provence. Médecin, il entre à l'hôpital militaire de Toulon en 1791 pour ne pas faire la guerre. Nommé chirurgien au Val de Grâce, il suit l'enseignement donné par Pinel alors médecin à la Salpêtrière. En 1800 il devient médecin chef de l'institut de jeunes sourds à Paris jusqu'à sa mort en 1838.
Il veut importer le langage oral à la place du langage des mimiques de l'Abbé de l'Epée et tente d’imposer la démutisation. Il soigne les sourds-muets chez lui. Il publie sur la rééducation des sourds. En 1828, il présente un important mémoire sur le mutisme produit par la lésion des fonctions intellectuelles. Il constate qu’il existe des surdités d’origines purement psychiques.

Itard va alors accueillir “Le sauvage de l’Aveyron”, un enfant trouvé dans les bois où il parait avoir survécu depuis des années.
Cet enfant représente pour la société de l'époque, "le bon sauvage" de J.J. Rousseau. On pense que la culture qu'on va lui apporter va arriver sur un terrain neuf. C'est ainsi un bon sujet d'expérimentation. Pinel l'a déclaré incurable mais Itard décide de s’en occuper. Cet enfant a une allure bizarre, il se balance, ne peut pas se fixer, a des manifestations gustatives et odorantes mais sans raffinement. Il mord et crie. Il entend les bruits mais seulement ceux qui ont rapport avec ses besoins, il est redoutable quand il a faim, regarde la lune en geignant. Itard pense comme Pinel qu'il faut mettre un être malade mentalement dans un milieu organisé, pour soigner mais surtout que si Victor (nom qu'il lui donnera par la suite) est sans langage c’est qu'il n’a pas bénéficié de la société des hommes. Il va s'en occuper de 1801 à 1806.
Victor va mourir en 1828 chez madame Guérin qui avait assisté Itard dans l'éducation de son élève. Elle le gardera, même quand Itard déclarera en avoir terminé avec lui.
